The operation and reclamation requirements, as identified in the <br /> request for a Limited Impact Operation Permit for the Red Jasper Granite <br /> operation, as amended, submitted to the Colorado Mined Land Reclamation <br /> Board (MLRB) and the Bureau of Land Management (BLM) , is hereby made a <br /> requirement in part and in whole for all contracts issued for this site. <br /> Compliance with the terms and conditions found in this document and those <br /> Imposed by the MLRB and the BLM are mandatory. <br /> 2. Operations at the quarry site will be confined to daylight <br /> hours, seasonally adjusted, during the period Monday thru Friday. <br /> No operations will occur prior to one half hour before sunrise and <br /> one half hour after sunset. In addition. blasting will be confined <br /> to this same time period. <br /> 3. The entire disturbed area will be fenced to exclude livestock <br /> during the period of vegetative establishment. This can be accomp- <br /> lished through new fence construction or closure of the affected <br /> pasture. All fence construction should include a minimum of four <br /> wires with solid corners and stretch panels installed as appropriate. <br /> 4. Adequate vegetative cover based on the potential of the site will <br /> be established prior to the formal abandonment of the material site. <br /> Experience has shown that a minimum of two growing seasons is necessary <br /> before long-term establishment of the vegetation can be properly <br /> evaluated. <br /> 5. The operator will notify the authorized officer of the Bureau of <br /> Land Management prior to beginning construction activities, prior to <br /> completion of removal operations. and prior to initiation of surface <br /> reclamation operations at this site. <br /> 6. The purchaser is responsible for obtaining and maintaining a legal <br /> and equitable easement and right-of-way for haulage purposes to the <br /> mine site identified in the contract. The purchaser is also responsible <br /> for obtaining and maintaining valid permits from the State of Colorado <br /> and the County of Teller to mine and remove aggregate from the site. <br /> Relinquishment, loss, or forfieture of one or all of these requirements <br /> will result in the termination and cancellation of this contract. <br /> 7. Use of roads across public land will be restricted during periods <br /> of excessive precipitation in order to avoid degradation due to �¢utting. <br /> Watering of access roads located on public lands will be requir I if <br /> use by vehicles in excess of 3 consecutive days occurs. Watering will <br /> be done by use of a suitably equipped water truck or some other suitable <br /> means. <br />
