RESPONSIBILITIES <br />a) This permit may be modified, suspended, or revoked in whole or in part during its tei,< <br />for reasons determined by the Division including but not limited to, the following:~~~ <br />(i) Violation of any terms or conditions of the permit; <br />(ii) Obtaining a permit by misrepresentation or failing to disclose eny fact whip: <br />Ss material to the granting or denial of a permit or to the establishment .: <br />terms or conditions of the permit; <br />(iii) Materially false or inaccurate statements or information in the application fc <br />the permit; <br />(iv) Promulgation of toxic effluent standards or prohibitions (including any schedul <br />of compliance specified in such effluent standard or prohibition) which ar- <br />established under Section 307 of the Clean Water Act, where such a tox~ <br />pollutant is present in the discharge and such standard or prohibition is mo; <br />stringent than any limitation for such pollutant in this permit. <br />b) This permit may be modified in whole or in part due to a change in any condition th, <br />requires either a temporary or permanent reduction or elimination of the permitti <br />discharge, such as: <br />(i) Promulgation of Water Quality Standards applicable to waters affected by tl <br />permitted discharge; or <br />(ii) Effluent limitations or other requirements applicable pursuant to the State A~ <br />or federal requirements; or <br />(iii) Control regulations promulgated; or <br />(iv) Data submitted pursuant to Part I.B indicates a potential for violation <br />adopted Water Quality Standards or stream classifications. <br />(v) Removal of a temporary modification to a stream standard thereby requiring t <br />application of the stream standard. <br />c) This permit may be modified in whole or in part to include new effluent limitations ae~~ <br />other appropriate conditions where data submitted pursuant to Part I.B.3 indicates the <br />such effluent limitations and conditions are necessary to ensure compliance wit' <br />applicable water quality standards and protection of classified uses. <br />d) At the request of the permittee, the Division may modify or terminate this permit i <br />the following conditions are met: <br />(i) In the case of termination, the permittee notifies the Division of its inter. <br />to terminate the permit 90 days prior to the desired date of termination; <br />5. Modification. Suspension. or Revocation of Permits By the Division (continued) <br />(ii) In the case of termination, the permittee has ceased any and all discharges ~ <br />state waters and demonstrates to the Division there is no probability of furth <br />uncontrolled discharge(s) which may affect waters of the State. <br />
