The acw_ toxicity limitation is exceeded if 1) a statistically significant difference in mortali~: (at the 95X confidence level) is observed for either species between the control and ae.. dilution less that or equal to the identified IWC or 2) a species mortality in any dilutiu~ of effluent (including 100X effluent) exceeds 50X. E. REPORTING 1. Signatory Requirements All reports required for submittal shall be signed and certified for accuracy by tl permittee in accord with the following criteria: a) In the case of corporations, by a principal executive officer of at least the level ~•~ vice-president or his or her duly authorized representative, if such representative responsible for the overall operation of the facility from which the discharE,- described in the form originates; b) In the case of a partnership, by a general partner; c) In the case of a sole proprietorship, by the proprietor; d) In the case of a municipal, state, or other public facility, by either a princip: executive officer, ranking elected official, or other duly authorized employee. F. SPECIAL REQUIREMENTS 1. Materials Containment Plan Pursuant to Sections 6.9.3 (5) and (6)(b) of the Regulations for the State Discharge Permi System, the permittee is required to submit a Materials Containment Plan. Such a plan sha] be submitted to the Permits and Enforcement Section, Water Quality Control Division withi ninety (90) days after the effective dace of this permit and must be implemented. The plr shall include information and procedures for the prevention and containment of spills <•i materials used, processed or stored at the facility which if spilled would have a reasonab] i probability of having a visible or otherwise detrimental impact on waters of the State i ~ ~. The plan shall include, but not necessarily be limited ta: a) A history of spills which have occurred in the three (3) years preceding the effecti~ date of this permit. The history shall include a causation of the spills and discussion of preventative measures designed to prevent them from reoccurring; b) A description of the reporting system which will be used to notify responsible facili~ management, the State Water Quality Control Division, the Environmental Protecti~• Agency, downstream water users within 5 miles downstream of the facility, and locr. health officials; c) A description of preventative facilities (including overall facility plot) whit prevent, contain, or treat spills and unplanned discharges;
