The acw_ <br />toxicity limitation is exceeded if 1) a statistically significant difference in mortali~: <br />(at the 95X confidence level) is observed for either species between the control and ae.. <br />dilution less that or equal to the identified IWC or 2) a species mortality in any dilutiu~ <br />of effluent (including 100X effluent) exceeds 50X. <br />E. REPORTING <br />1. Signatory Requirements <br />All reports required for submittal shall be signed and certified for accuracy by tl <br />permittee in accord with the following criteria: <br />a) In the case of corporations, by a principal executive officer of at least the level ~•~ <br />vice-president or his or her duly authorized representative, if such representative <br />responsible for the overall operation of the facility from which the discharE,- <br />described in the form originates; <br />b) In the case of a partnership, by a general partner; <br />c) In the case of a sole proprietorship, by the proprietor; <br />d) In the case of a municipal, state, or other public facility, by either a princip: <br />executive officer, ranking elected official, or other duly authorized employee. <br />F. SPECIAL REQUIREMENTS <br />1. Materials Containment Plan <br />Pursuant to Sections 6.9.3 (5) and (6)(b) of the Regulations for the State Discharge Permi <br />System, the permittee is required to submit a Materials Containment Plan. Such a plan sha] <br />be submitted to the Permits and Enforcement Section, Water Quality Control Division withi <br />ninety (90) days after the effective dace of this permit and must be implemented. The plr <br />shall include information and procedures for the prevention and containment of spills <•i <br />materials used, processed or stored at the facility which if spilled would have a reasonab] i <br />probability of having a visible or otherwise detrimental impact on waters of the State i ~ <br />~. The plan shall include, but not necessarily be limited ta: <br />a) A history of spills which have occurred in the three (3) years preceding the effecti~ <br />date of this permit. The history shall include a causation of the spills and <br />discussion of preventative measures designed to prevent them from reoccurring; <br />b) A description of the reporting system which will be used to notify responsible facili~ <br />management, the State Water Quality Control Division, the Environmental Protecti~• <br />Agency, downstream water users within 5 miles downstream of the facility, and locr. <br />health officials; <br />c) A description of preventative facilities (including overall facility plot) whit <br />prevent, contain, or treat spills and unplanned discharges; <br />
