Box 52A <br />Pagosa Springs, Colorado 81147 <br />SUBJECT: Certification of Sedimentation Pond No. 3 <br />Colorado Coal Mine No. 1, C-81-024 <br />Dear Mr. Keegan: <br />I have been assigned the responsibility of lead specialist for the CCMC No. 1 <br />Mine. I am a hydrologist and have worked in the coal section of the Division <br />for the last five years. <br />I inspected CCMC No. 1 both in June, 1991 and July, 1991. During both <br />inspections, the primary focus was the sediment control system. I was aware <br />that the location of the primary and secondary spillways on Pond B were out of <br />compliance with the design last spring, and that Mike Kolin had recertified <br />the pond in early May, 1991 following some remediation work. <br />I find the certification wanting. Construction of the Pond B embankment <br />apparently proceeded with little reference to the design. Consequently, <br />it is the certifying engineer's responsibility to prove that the as-built <br />configuration can handle the anticipated flows. Mr. Kolin appears to have <br />verified what was constructed, but he has not noted that his observations <br />differ dramatically from the design. I am enclosing a copy of our guidelines <br />for certification for your use and the use of your consulting engineer. <br />Please revise the certification and prove that the pond and the ditch between <br />Ponds A & B can handle the flows in a non-erosive manner. Please document the <br />sizing, depth and installation of the rip-rap. I am also concerned that the <br />outfall of Pond A will also not handle the flow where it currently goosenecks <br />to flow west and then south. Please check that area, too. <br />
