approval of this Permit. Any violation of the conditions of any other such permit issued to RFR
shall be deemed a violation of this Permit subject to all of the remedies provided for herein.
27. Pursuant to Section 10.05.050(F) of the RMC, unless an extension is requested
prior to the expiration date, if the proposed activities for which this Permit is issued are not
commenced within twelve (12) months from the date hereof, this Permit shall expire and become
void. In the event RFR cannot commence mining operations within twelve (12) months from
the issuance of this Permit, but has diligently proceeded in acquiring the other necessary permits
and approvals for the operation, the Ciry shall grant one (1) additional twelve (12) month
extension to commence operations.
28. This Permit shall expire upon the determination by the DMG that all reclamation
pursuant to the DMG Permit to be issues has been complete and the DMG Reclamation Bond
released.
29. A copy of this Permit shall be sent by certified mail, return receipt requested, to
RFR.
30. This Permit may be assigned or conveyed by RFR or any agent of RFR only with
the prior written consent of the City, which consent shall not be unreasonably withheld and
provided that RFR is not then in default under any term or provision of this Permit or any permit
referred to in Paragraph 26 above, and further provided that the transferee agrees in writing to
be bound by all of the terms and conditions set forth within this Permit. The City acknowledges
that RFR is under contract with Western Mobile, Inc. to assign its rights under this Permit and
hereby consents to such assignment subject to compliance with the terms and conditions of this
Paragraph at the time of assignment; and provided that any further assignment shall comply fully
with this Paragraph 30.
