Stormwater Requirements (continued) <br />2) Request for Termination <br />When a site has been reclaimed in accordance with the CDMG requirements and the site has been released from <br />State reclamation requirements, or the above Termination Criteria have been met, the permittee may request <br />termination of stormwater coverage under this permit. The Division will consider termination of stormwater <br />coverage when: <br />a) the perminee has submitted a completed Inactivation Form as provided by the Division which summarizes <br />the work accomplished; <br />b) In the case of mine-waste remediation projects, the permittee has submitted photographic documentation of <br />the post remediation conditions at the mine site; <br />c) All stormwa[er discharges to state waters associated with mining activities have ceased and the permittee has <br />demonstrated to the Division the termination criteria have been met or the CDMG performance bond has <br />been released; <br />d) The Division finds that the petmittee has shown reasonable grounds consistent with the Federal and State <br />statutes and regulations for such termination; and <br />e) Fee requirements of Section 6.16.0 of State Discharge Permit System Regulations have been met. <br />Continued coverage may be required after reclamation or remediation has been completed if the Division has <br />shown or has reason to suspect that the stormwater discharge may contribute to a violation of a water quality <br />standard. <br />i. Stormwater Definitions <br />I . Best management practices (BMPs): schedules of activities, prohibitions of practices, maintenance <br />procedures, and other management practices to prevent or reduce the pollution of waters of the State. BMPs <br />also include treatment, operating procedures, and practices [o control site runoff, spillage or leaks, waste <br />disposal, or drainage from material storage. BMPs include structural and nonswcmral controls. <br />2. Operator: the individual who has day-to-day supervision and control of activities occurring at [he mine site. <br />3. Remediation, as used in this permit, means actions taken to reduce or eliminate the overall adverse <br />environmental impact associated with a pollutant source. The term includes actions such as re-routing of surface <br />flows, re-location or a pollutant source, the addition of pollutant neutralizing or immobilizing substances, <br />capping and re-vegetation. <br />4. Significant Materials include but are not limited [o: raw materials; fuels; materials such as metallic products; <br />hazardous substances designated under section 101(14) of CERCLA; fertilizers; pesticides; and waste products <br />such as ashes, slag and sludge that have the potential to be released with stormwater discharge. <br />E. GENERAL MONITORING, SAMPLING AND REPORTING REQUIREMENTS <br />I. Routine Retwrtine of Data <br />Reporting of the data gathered in compliance with Pan I.B.I shall be on a quarterly basis. Reporting of all data <br />gathered shall comply with the requirements of Pan I.E. (General Requirements). Monitoring results shall be <br />summarized for each calendar quaver and reported on Division approved discharge monitoring repon (DMR) forms <br />(EPA form 3320-1). One form shall be mailed to the Water Quality Control Division, as indicated below, so that <br />the DMR is received no later than the 28th day of [he month following the end of the quaver (for example, the <br />DMR for the first calendar quarter must be received by the Division by April 28th). If no discharge occurs during <br />the reponing period, "No Discharge" shall be reported. <br />
