Compliance Certificarion: Everv permittee who has received a Nationwide <br />permit vertfication from [he Curps will submit a signed ceretfication reeardine the completed <br />work and any required mttigation. The certif[cation will be forwarded by the Corps with the <br />authorization letter and will include: <br />a. A statement that the authorized work was done in accordance with the Corps <br />authorization, including any general or specifc conditions: <br />b. A statement that any required mitigation was completed in accordance tivith the <br />permit conditions; <br />c. The signature of the permittee certifying [he completion of the work and <br />mitigation. <br />15. ~tfultiple Use of Nationwide Penults: In any case where any NWP number 12 <br />through 40 is combined with any other NWP 1? throueh 40. as part of a single and <br />complete protect, the permitter must notifv the Dis[rict Engineer in accordance with <br />paracraphs a, b, and c on the "Notification" Genera! Condition number l3. Any NWP <br />number !through 11 may be combined with any other NWP without n,ttficacion [o the <br />Corps, unless notification is otherwise required by the tams of the NWPs. :\s provided at <br />33 CFR 330.6(c) two or more different NWPs can be comhined to authorize a single and <br />complete project. However, the same NWP cannot be used more than once for a single and <br />complete project. <br />B. SECTION 404 ONLY CONDITIONS: In addition to the General Conditions, the <br />following conditions apply only to activities that involve the discharge of dredged or fill <br />material into waters of the United States, and mus[ be followed in order for authorization by <br />the Nationwide Permits to be valid: <br />1. tyater Supply Intakes: No discharge of dredged or fill material may occur in the <br />proximity of a public water supply intake except where the discharge is for repair of the <br />public ~va[er supply intake structures or adjacent bank stabilization. <br />2. SGellfislr Production: ^lo discharge of dredged or fill materta[ may occur in <br />areas of concentrated shellfish production, unless the discharge is directly related to a <br />shellfish harvesting activity authorized by NWP 4, <br />3. Srtitable Afaterral: No discharec of dredged or fill materia[ may consist of <br />unsuuablr material (r.g., trash. debits. ~.ir hodics, asphalt, etc..) and ma[ena! discharged <br />must be free from toxic pollutants in toxic amounts (see section 307 of the Clean Water <br />Actl. <br />4. Aflligation: Discharges of dredged or fill material into waters of the United <br />States must be minimized or avoided to the maximum extent practicable ac the project site <br />li.e.. un-site). unless the District Engineer approves a compensation plan that the Distrtct <br />[nginrer determines is more hrneiicial to dtc environment than on•site mmimiza[ion or <br />avoidance measures. <br />G <br />
