Thence South 06°10' 17" West, along the West line of. said <br /> 11.540 acre tract of land, 659.36 feet to the South line <br /> of the Northeast Quarter (NE;) of said Section 2; <br /> Thence North 89055'53" West, along the South line of the <br /> Northeast Quarter (NE,) of said Section 2, a distance of <br /> 7 851.81 feet to the True Point of Beginning. Said tract <br /> of land contains 75.000 acres and is subject to any <br /> Rights-of-way or other Easements as granted or reserved <br /> by instruments of record or as now existing on said tract <br /> of land. <br /> WHEREAS, the petitioner was present, and <br /> WHEREAS , the petitioner presented evidence in support of the <br /> grant of the Special Use Permit on the above described real estate, <br /> and <br /> WHEREAS, evidence was presented by surrounding property owners <br /> in opposition to the proposed Special Use Permit, and <br /> WHEREAS, Section 3. 3. (E) 4 . 1. of the Weld County Zoning Resol- <br /> ution authorizes such a use in the Agricultural District subject <br /> to the additional requirements of Section 6 . 1 ( 3) of the Weld County <br /> Zoning Resolution and upon approval by the Board of County Com- <br /> missioners , and <br /> WHEREAS, the Board of County Commisisoners of Weld County, <br /> Colorado heard all the testimony and statements of those present , <br /> has studied the request of the petitioner and the recommendations of <br /> the Weld County Planning Commission and all of the exhibits and <br /> evidence presented in this matter, and having been fully informed <br /> and satisfied that the request for a Special Use Permit for an <br /> open cut mining permit and gravel pit on the above descrired real <br /> estate conforms to the purposes of Section 3 . 3 .E. of the Weld <br /> County Zoning Resolution and the requirements of Section 6 . 1 ( 3) of <br /> said Weld County Zoning Resolution. <br /> NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- <br /> missioners of Weld County, Colorado, that the application of the <br /> petitioner for a Special Use Permit for an open cut mining permit <br /> and gravel pit, on the above described tract of land, be and hereby <br /> is, granted, subject to the Development Standards read into the <br /> record June 7, 1978, provided, however, that Development Standar%i <br /> Number 7 be amended to require fencing of the southeast corner of <br /> -2- <br />
