At <br />the present time the hay lands located directly north of Pond B <br />cannot be irrigated and farmed. The lessee - rancher intents to <br />plant corn on the to be irrigated area. <br />The new ditch would traverse some of the permit area and come to <br />within 10 feet of berm of a topsoil storage area, however, would <br />not interfere with any of the ditch system installed to collect <br />and conduct any surface water runoff from the disturbed area. <br />The purpose of the ditch is strictly for farming and will not be <br />utilized in any way by the mining operation. <br />Your approval for the construction of this ditch, shown in red on <br />the attached map, would be greatly appreciated. <br />Sincerely, <br />E.
