APPLICANTS WILL COMPLY WITH THE FOLLOWING:
<br />OPERATIONS STANDARDS (6.1.3.E)
<br />1. No excavation or processing of sand and gravel shall be
<br />permitted nearer than 10 feet to the boundary of adjacent
<br />property, easement or irrigation ditch or right -of -way,
<br />nor nearer than 125 feet to "any existing residence,
<br />unless by written agreement the owner or owners of such
<br />adjacent property consent to a lesser distance and the
<br />Planning Commission approves such lesser distance. The
<br />Planning Commission may set a greater distance than
<br />mentioned above when, in their opinion, it is justified.

<br />2. All sand and gravel operations shall be conducted during
<br />the hours of daylight except in the case of public or
<br />private emergency, or to make necessary repairs to equip-
<br />ment. This restriction shall not apply to operation of
<br />administrative and executive offices or repair facilities
<br />located on the property.
<br />3. A landscaping greenbelt shall be planted along the entire
<br />length of the southern boundary. The greenbelt shall
<br />consist of two parallel rows of trees. The southern-
<br />most row shall contain Rocky Mountain Junipers planted
<br />8 feet apart. The nozlthernmost row shall contain Native
<br />Plum trees and Russian Olive trees, on an alternating
<br />basis eight feet apart. The entire greenbelt shall be
<br />planted within five years of approval by the Board of
<br />County Commissioners.
<br />4. Existing trees and ground cover along public road
<br />frontage and drainageways shall be preserved, maintained
<br />and supplemented if necessary, for the depth of the
<br />setback in order to protect against and /or reduce noise,
<br />dust and erosion.
<br />5. The easternmost access onto East 16th Street shall be
<br />utilized as a truck access for a period of time not to
<br />exceed 120 days from approval by the State Mined Land
<br />Reclamation Board. After the 120 day time limit, this
<br />access shall not be utilized by truck traffic. It shall
<br />be signed against use for truck traffic and the gate
<br />shall be kept locked for public use. The western access
<br />onto East 16th Street is approved by the Board of County
<br />Commissioners as a truck access. If access to the east
<br />to Fern Avenue can be obtained, it is also approved as
<br />a truck access.
<br />6. Each access road(s) shall be paved from the point of
<br />intersection with the public road to a distance within
<br />the Special Use Permit area equal to the depth of the
<br />neighbor's land.
<br />7. Six foot chain -link fencing shall be erected around
<br />each phase prior to extraction of that phase. The
<br />fencing shall remain in place until thetreclamation is
<br />completed for that phase.
<br />8. Where topsoil is removed, sufficient arable soil shall
<br />be set aside, for respreading over the excavated area.
<br />9. A portable rock crusher, a concrete plant, and an asphalt
<br />plant are permitted within the condition that they shall
<br />be restricted from locating within Phases III, IV, V, VI,
<br />VI -A, VII, VII -A, and VIII -A in order to maintain a
<br />reasonable distance between these portable facilities
<br />and the residential uses to the south.
<br />10. Insurance - The operator shall furnish evidence he is
<br />insured to the extent of not less than $100,000.00
<br />against liability for any negligent act or omission
<br />by the operator from the operation or maintenance of
<br />the sand and gravel ?it and the extraction and production
<br />of sand and gravel and all activities connected with or
<br />incidental thereto. (Rev. 7/15/70).
<br />11. A separate emission permit application shall be applied
<br />for and obtained through the Weld County Health Depart-
<br />ment for a rock crusher, an asphalt plant, or a concrete
<br />plant. Also, a fugitive dust emission permit shall be
<br />applied for and obtained through the Weld County Health
<br />Department.
<br />12. There shall not be any dumping of any kind permitted
<br />within the Special Use Permit area either during extraction
<br />or during reclamation.
