RE: Pre-hearing Conference and Formal Public Hearing for the Benson Brothers Red Shale Pit,

Dear Party and/or Interested Person:
The Colorado Division of Minerals and Geology (DMG) has received objections to the application for the Benson
Brothers Red Shale Pit 112c permit.
A Pre-hearing Conference has been scheduled to occur on Anri125, 2006, beginning at 1:00 p.m., at the
Cedaredge Community Center, 140 NW 2"d Street, Cedaredge, Colorado. Ms. Sandy Brown will preside as Pre-
hearing Conference Officer. Ms. Brown will ask the parties to assist her in preparing apre-hearing order to
propose to the Board that identifies the parties, the issues, possible witnesses and exhibits for the hearing, and an
estimate of the time needed for the hearing. Ms. Brown will also discuss the Office's review process, as well as
the rights and responsibilities of parties.
Staff has scheduled the matter for Formal Public Hearing before the Colorado Mined Land Reclamation Board.
The hearing on the application for the Benson Brothers Red Shale Pit 112c permit will occur during the Mav 10-
11, 2006 Board meeting at 1313 Sherman Street, Room 318, Denver, Colorado, commencing at 10:00 a.m. or as
soon thereafter as the matter can be considered. Parties and interested persons will have the opportunity to be
heard.
Please be aware that the decision due date for this application is June I5, 2006, not June 13, 2006 as stated in
DMG's Status Update dated February 15, 2006.
