Ungefug - 2 - February 1, 1991 <br />Exhibit L - Reclamation Costs <br />The proposed reclamation costs are acceptable with the inclusion of indirect <br />costs, calalated at 15,18% of the direct costs. <br />Exhibit P -Owners of Record <br />The copies of the deed provided are illegible, however the tax notices will be <br />sufficient. <br />Other Comments <br />Enclosed are letters of comments from the U.S. Department of the Army, <br />Albuquerque District Corp. of Engineers and from the Colorado Division of <br />Wildlife Southeast Regional Office. We would appreciate any responses you <br />have to these comments. <br />As I discussed by telephone on January 31, 1991 with Mr. John Ungefug of <br />Southway Constuction, the Division believes that approving this permit would <br />be in violation of Section 34-32-110(7)(a) of the Colorado Mined Land <br />Reclamation Act. Therefore, as presently proposed, the Division must <br />recommend denial of the application. As was also discussed, if the new 112 <br />application is modified to exclude the area currently occupied by Southway's <br />170(2) F~ermit number M-89-096, and the adequacy issues presented in this <br />letter are resolved, the staff will recommend approval of the 112 <br />application. In this case, the 110 permit area could be amended into the 112 <br />area after the 110(2) permit has been held for two consecutive years. <br />If you have any questions about these issues please contact me. <br />Sincerely, <br />,~ n <br />Gregg R.
