4- 18 <br />• 4.2.5 Water Rights <br />All water used in the mining and pollution control operations will be obtained from the <br />Colorado River near Loma. Grand Valley has a first and prior right to 10 cfs of water from the <br />Mack Pumping Pipeline as set forth in C.A. No. 13368, Mesa County District Court by decree, <br />April 13, 1972, and as modified May 29, 1974 (See Appendix C). Consumptive use is <br />discussed in Section 2.4.3. <br />Rule 2.04.7 requires that the applicant provide well locations and reported yields for all wells <br />within the permit area and adjacent areas. No wells are registered with the Colorado Division of <br />Water Resources within two miles of the permit area. The closest well is approximately 2.25 <br />miles south east of the permit area and is located next to Big Salt Wash. <br />Rule 2.04.7 also requires that the applicant provide information on water supply intakes, <br />ditches, reservoirs, and wells within one mile of the affected area. The only such structure is the <br />H. F. McClain Ditch, see Figure 1.1-3a. The owner is Young, Inc.
