<br /> <br />You have included an amount of 23 acres and the phrase "mined to slope" in Exhibit L, which I interpret to mean <br />that there will be no more than 23 acres to fully reclaim at any one time, and that you will mine at all times on a 3: I <br />slope. This is my interpretation, because these statements aze not expressly made in Exhibit D. If my <br />understanding of these details is incorrect, please let me know. (I will explore this below under Exhibit L.) <br />The detail discussed above about 3:1 slopes on all highwalls, at all times, is important since it will greatly affect the <br />bond amount. If that is part of your final approved plan, you must not mine at steeper slopes; all temporary and <br />final slopes must be at the reclamation gradient of 3:1. Whatever you are approved for, the bond must cover all <br />outstanding reclamation to perform, in the situation of an operator defaulting at any time, for which the State would <br />rely on the posted bond to complete. <br />I will add the material processing activities of concrete and asphalt hatching to your mining plan. Please be aware <br />that certain sites or pieces of equipment involved in such activities may require special permits from the county or <br />Air Pollution Control Division. Please ensure that you obtain the necessary permits. <br />You have sho«m and described a scale in your mining plan and map. Will this be installed at existing grade, and/or <br />include removable concrete ramps, sub-grade walls? Will the scale be removed at the time of demolition of the <br />existing modular structure (which will be utilized until that time as the scalehouse), or will you install a different <br />scalehouse? Please clarify. <br />The seepage question appears to be answered inasmuch as there may be a sufficient horizontal distance between the <br />canal and ditch and the nearest point of the pit. Please be aware that the Division will monitor for the occurrence of <br />any seepage in the pit, from these conveyances and from the neighboring recharge pit. If there is any exposure of <br />groundwater, exhibited as seepage or impounded water, you will be required to backfill it, until you can adequately <br />demonstrate rights to expose groundwater. For now, I will consider this to be answered. <br />Please provide information as to the closure of the well, which will be performed at the time of excavating the area <br />in the location of the well. This should be in conformance with standards set forth by the State Engieer's Office, <br />and may part of the posted bond amount. (You may contact the Division of Water Resources in Alamosa for <br />information.) <br />Exhibit E -Reclamation Plan <br />Your plan appears complete, with all questions answered. I can now reasonably begin to estimate the bond. <br />Additionally, you have also clarified the questions related to wildlife use of your area. The file will now reflect that <br />the site will be reclaimed to rangeland. <br />Exhibit F -Reclamation Map <br />Thank you for the updated map. It now depicts a fully mined site. Is the pit floor to be level, or will it also gently <br />slope toward the northeast comer, as the undisturbed surface now does? <br />Exhibit L -Reclamation Costs <br />This list is more complete than before, and will be utilized when I perform a cost estimate. Please be aware that if <br />any of the interim highwalls are to be created and left temporarily at slopes steeper than 3:1, we must know about it <br />and require bonding as necessary. At this time, I will assume that all slopes will be 3:1 or gentler at all times, as <br />you have indicated in this exhibit. <br />Likewise, the maximum number of acres of disturbance must be known, so that the necessary bond maybe <br />calculated. I will estimate the costs for 23 acres, based on your information in this exhibit. If these assumptions aze <br />incorrect, please notify me. <br />
