<br />Dear Mr. Raines:
<br />We have reviewed your June 2, 2003 letter requesting renewal of the substitute water
<br />supply plan in accordance with Senate Bill 89-120 for a sand and gravel pit previously operated by
<br />Western Mobile Southern (WMS), a subsidiary of Lafarge Corporation. Additional engineering
<br />was received by a-mail on March 29, 2004. The required renewal fee of $217.00 has been paid.
<br />The applicants shall be responsible for compliance with this plan, but the State Engineer's Office
<br />may also pursue the landowner for eventual compliance.
<br />This pit did not exist, and no ground waterwas exposed, prior to January 1, 1981.
<br />Previous approvals were for dry mining, with the only water exposure consisting of dewatering
<br />trenches (0.3 acres), a collection area (0.1 acres), a return trench (0.1 acres), and a wash water
<br />pond (0.4 acres). Well permit no. 054064-F (ID 1406561) was obtained for this pit. Ten acres
<br />have been disturbed by mining; however, no mining is occurring, and the site is kept in a
<br />dewatered state. Only the dewatering trench, the collection area, and the return trench currently
<br />expose groundwater. The total exposed surface area for this plan year is 0.5 acres, and only the
<br />evaporation of this water is the subject of this plan.
<br />You estimate the anticipated annual consumption to be approximately 1.7 acre-feet per
<br />year, which is summarized on the Monthly Evaporation Table (attached). Your stream depletion
<br />analysis is also attached providing a monthly distribution of the steam depletion. You have
<br />calculated total stream depletions to be 1.8 acre-feet for the April 1, 2004 through March 31, 2005
<br />plan year.
<br />Replacement water will be provided by the Board of Water Works of Pueblo. A lease
<br />agreement has been submitted for the period April 1, 2001 -March 31, 2006 for consumable
<br />water. The leased amount for the period April 1, 2004 through March 31, 2005 is 10 acre-feet.
<br />W MS also holds a bond with the Division of Minerals and Geology in the amount of $838,618,
<br />which is sufficient to backfill the exposed surface.
<br />The State and Division Engineers have reviewed the plan and the adequacy of each
<br />source of water provided for use as augmentation water, including, where necessary, the
