The Division of Minerals and Geology (Division) is required to make an approval or denial <br />decision no later than September 30, 2005, therefore, your response to the following adequacy review <br />concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice circulated <br />in the local newspaper, and proof of notice to all owners of record of surface lands that are in or <br />within 200 feet of the boundary of the affected land, including easement holders. Proof of notice may <br />be Certified Mail return receipts or proof of personal service. <br />Rule 6.3.2 Exhibit B -Site Description <br />2. To help substantiate the reported 2-inch topsoil depth at the site, please provide the soil survey map <br />for the site corresponding to the soil type reports provided. On the map, ensure that the permit site is <br />outlined. <br />3. Please identify the owner of the fence shown within 200 feet of the pit boundary, and provide proof of <br />notice to the owner. <br />Rule 6.3.3 Exhibit C- Mining Plan <br />4. Since the overview indicates this pit will be used intermittently, the applicant may want to include a <br />statement that conforms to the provisions of Section 34-32.5-103(11)(b), C.R.S., as noted in Rule <br />6.3.3{a) to preclude the need to file a notice of temporary cessation for what will be normal <br />operations. <br />5. Per Rule 6.3.3{b), please clarify whether the topsoil will be reapplied on a graded area within a year <br />after salvage.
