Simpson, P.E. <br />Stale Engineer <br />Pursuant to your recent inquiry regarding the Herman Feit Gravel Pit, DMG # M-77-522, <br />this office has researched our files to determine the status of the water issues associated <br />with this operation. If the exposed groundwater associated with this site was exposed as <br />a result of the mining of sand and gravel, the applicant, pursuant to C.R.S. 37-9U-137 (111. <br />must obtain a gravel pit well permit. From our files it does not appear that th~~ applicant <br />has obtained such a gravel pit well permit. In addition, if the groundwater w~~s exposed <br />after December 31, 1980, either a water court approved augmentation plan or a State <br />Engineer approved substitute supply plan, to replace the depletions to the stre:lm system <br />resulting from open mining of sand and gravel, must also be obtained.
