<br />keep the Pr ope r[y free and clear of le ins and encurtb ra nces resulting fr tm
<br />its activities hereunder.
<br />13. Breath by Peabody. Bogle shall have rights against Pe ab odv, a[
<br />law and equity, far breach of [his agre eaent, including injunction and damages,
<br />and including reasonable alto rney's fees. If Bogle believes a breach of this
<br />agreement has occurred, Bogle shall so notify Peabody. lf, within sixty (60)
<br />days thereafter, Peabody has not (a) de nib the breazh, in vri titg; or (b)
<br />cured the breath; or (c) ins[igat ed steps reasonably calculated to cure such
<br />breach within a reasonable period of time, then the this agreane n[ shall
<br />automrt is al ly [e rminaie. 1{ access to [he Pr op'r[y is netes sa ry in order to
