Sims Gravel Company a notice of <br />Possik~le Violation on their East Douglas Pit (CMLRD Permit No. <br />M-87-103) in Rio Blanco County, CO. The referenced pit is <br />located on Bureau of Land Management lands and is authorized <br />under a permit this office issued in April 1987. <br />We have had several meetings with Mr. and Mrs. Sims about <br />possik~Ie problems with the subject pit area. They have always <br />been very cooperative in correcting any problems that we have <br />identified. During the last meeting on January 14, 1992, this <br />office: reached agreement with the Sims' on resolving the <br />remaining problems with the pit, which included a commitment to <br />survey the permit boundaries to see if the permit needed to be <br />amended to incorporate an area to stockpile mined material. <br />For these reasons, we were quite surprised to see your letter to <br />Mrs. :'~ims and Mr. York-Feirn's Inspection report that identified <br />a ELM employee's complaint as the reason for your office <br />conducting the inspection. It is not the BLM's policy to request <br />assistance of other agencies in resolving potential problems on <br />Public: Lands unless all remedies at our disposal have failed, and <br />even then the request would be transmitted through formal <br />channels. As far as I am aware this did not occur. <br />The fact that a small area partially outside the existing permit <br />boundaries may have been utilized as a stockpile area is <br />considered to be a very minor problem. We are therefore <br />requesting that you cancel the formal public hearing on this <br />matter'. If it is determined, upon completion of the above <br />mentioned survey, that a boundary adjustment is necessary we will <br />amend the BLM permit to include the new area and require the <br />company to contact your division to make any needed adjustment to <br />the CMLRD permit. <br />
