DANIELSON, DEPUTY STATE ENGINEER SUBJECT: SUBURBAN SAND AND GRAVEL COMPANY - ROAD RUNNERS REST II x'79-195 APPLICATION FOR MINING AND RECLAMATION PERI'fIT As requested by your office, we have reviewed the application for a sand and gravel mining operation near Henderson on the South Platte River and the following comments are presented for your consideration: 1. Exhibit G states that 5 irrigation wells are located on the mined land and will continue to be used for irrigation until such time as excavation operation reaches the irri- gated area for a specific well. These wells are subject to the Rules and Regulations of the State EYtgineer as decreed by the Division 4later Court on March 15, 1974. Basically, these rules and regulations prohibit the use of these wells unless operating in accordance with an approved plan for augmentation. We have checked the records of our Division Engineer and cannot find that these wells are operating under an approved plan for augmentation, Therefore, our Division Engineer will take the necessary steps to shut down these wells until operating under an approved plan for augmentation. 2. It is stated that two of the wells will be used to supply dust control and water for the crusher. We must point out that the wells have been decreed for irrigation purposes only and cannot be used for other purposes until a change in use has been obtained and until a plan For augmentation has been approved. Therefore, a water supply for the mining operation is not available. 3. The statement is made that it is the operator's intention to minimize the disturbances to the hydrologic balance. However, the impact upon the hydrologic balance has not even been deterrnined nor have any procedures or methods been offered to minimize the disturbances that will occur. The South Platte
