Box 39 <br />Hugo, CO 80821 <br />RE: Permit Application No. 05LI0363F, Surface Mining Operation <br />Dear Mr. Don Blake: <br />oF'~oto <br />RQ <br />e <br />or'i O <br />f t <br />• s <br />Y re76 ~ <br />Colorado~Deppartrnent <br />of PubL'cflealth <br />and Environment <br />APEN REQUIRED <br />PERMIT EXEMPT <br />The Air Pollution Control Division (the Division) received your permit application no. 05LI0363F for the sand <br />and gravel surface mining operation known as Hoffman Pit, located at North of I-70 about 1 1/2 miles west <br />of Genoa, CO, T9S, R55W, SW1/4 of the SE1/4 of Section 10, Lincoln County, Colorado. The Division <br />determined no emission permit is required for the above referenced source since surface mining activities <br />that mine 70,000 tons per yearor less are specifically listed as being exempt from permitting requirements <br />(Reference: Regulation No. 3, Part B, Section II.D.1.g.). However, an Air Pollutant Emission Notice (APEN) <br />is required since uncontrolled emissions of particulate matterwill be more than 2 tons per year(Reference: <br />Regulation No. 3, Part A, Section 11.6.3.a). <br />This exemption from permit requirements is issued in reliance upon the accuracy and completeness of <br />information supplied by the applicant and is conditioned upon construction, installation, and operation in <br />accordance with this information and with representations made by the applicant orthe applicant's agents. <br />Specifically, this exemption has been granted provided that the following information is accurate and <br />complete: <br />The production rate does not exceed 70,000 tons per year. Annual records of the actual production <br />rate shall be maintained and made available to the Division for inspection upon request. <br />2. The applicant shall follow the fugitive dust control plan as submitted with the application. <br />The following emissions (with controls) of total suspended particulates (TSP) and particulate matterof less <br />than ten microns (PM1e) are estimated based on the production rates listed on the APEN. This information <br />is listed to inform the operatorof the Division's analysis of the TSP and PM1e emissions.
