Walther <br />Executive Direttor <br />Hal D Simpson, P.E. <br />State Engineer <br />We have reviewed your August 3, 2001 letter on behalf of Colorado Lime Company, Inc. <br />(d/b/a Calco) requesting approval of a substitute water supply plan for the Monarch quarry. The <br />quarry site was previously owned by C.F. & I. Corporation, which mined limestone until the <br />1960's. While Calco has been hauling product from the site, it is now applying for a mining <br />permit from the Colorado Department of Minerals and Geology (DMG), and needs an approved <br />water source to obtain that permit. Information submitted to DMG (file no. M-2000-98) indicates <br />that quarrying could last for a period of 20 years. <br />Water needs for dust suppression and equipment washing have been and will be <br />supplied primarily from a surface diversion on an unnamed tributary of the South Arkansas <br />River. Diversions are estimated to be 1,000 gallons per day from June through September, <br />totaling 0.374 acre-foot annually, all of which is considered to be consumed. <br />Your letter references an existing well (permit no. 16342-R, case no. W-2111, Ident no. <br />1105392) as a possible alternate water supply. You state this well is damaged and would have <br />to be repaired or replaced prior to its use. The well is decreed for sanitary, domestic, <br />manufacturing, and power purposes, none of which are the industrial mining uses that are the <br />subject of this plan. Prior to obtaining a replacement permit or use of this well under this plan <br />Calco must document that the uses approved under this plan are included in the well's decree. <br />The proposed source of replacement water would be 0.5 acre-feet of Twin Lakes Water <br />leased from the Upper Arkansas Water Conservancy District, which the District has stored in <br />North Fork Reservoir. While Twin Lakes water is not 100% consumptive, 0.5 acre-foot is <br />expected to yield 0.374 acre-feet of consumptive credits. <br />The State and Division Engineers have reviewed the plan and the adequacy of each <br />source of water provided for use as augmentation water, including, where necessary, the <br />historical consumptive use of each water right, and return flows from diversion of waters <br />imported into the Arkansas River Basin or other fully consumable waters proposed for use as <br />augmentation water. In accordance with Section 25-8-202(7), C.R.S. and Senate Bill 89-181 <br />Rules and Regulations adopted on February 4, 1992, the State Engineer has determined that <br />
