Perry,Ckrk & Recorder,Logan CounT~ <br />{c) Lessee shall keep the Leased Premises and the whole <br />and every part thereof free and clear of liens for <br />labor done or work performed thereon or operations <br />thereof under this Lease, and shall keep the Leased <br />Premises free from all other forms of encumbrance, <br />and will save and keep harmless Lessor from all <br />costs, loss or damage which may arise by reason of <br />injury to any persons employed by Lessee in or upon <br />the Leased Premises or any part thereof, or which <br />may arise by reason of injury to any persons or <br />damage to any property as a result of any work or <br />operations of Lessee, or which may arise from any <br />and every other action of Lessee on account of <br />Lessee's possession and occupancy of the Leased <br />Premises. <br />(d) In digging pits for the use of Lessee hereunder, <br />Lessee agrees to make separate stockpiles of <br />topsoil and of waste substances. Lessee agrees <br />that on completion of the removal of sand, gravel <br />and rock from pits that have been dug on the Leased <br />Premises, Lessee will back-slope such pits with <br />unused waste substances and materials used for <br />roadways, place topsoil on top and reseed said <br />back-slopes with native grass. <br />(e) Prior to commencement of any exploratory, <br />extractive or other mining operations on the Leased <br />Premises, Lessee shall develop a detailed written <br />plan for such operations, which plan shall be <br />submitted to Lessor for its review and approval, <br />which approval shall not be unreasonably withheld <br />or delayed. Such plan shall set fortri, without <br />limitation, exact locations of intended operations <br />and access routes, fences, cattle guards, access <br />gates and other necessary measures required to <br />protect Lessor's use of adjacent property. All <br />mining and related sites developed, maintained or <br />used by Lessee shall be so developed, used and <br />maintained in accordance with the approved mining <br />plan. <br />(f) Lessee shall at no time disturb a greater area of <br />the Leased Premises for its operations than can <br />reasonably be mined and marketed within eighteen <br />(18) months. In no event shall a total area in <br />excess of ten (10) acres be disturbed at any <br />one time. <br />4 <br />U Li <br />
