(._ ~ <br />I. GENERAL TERMS AND CONDITIONS: <br />A. INITIAL APPROVAL: <br />• 1. This permit is issued in reliance upon the accuracy and completeness <br />of information supplied by the applicant, and is conditioned upon <br />construction, installation, and operation in accordance with this <br />information and with representations made by the applicant or its <br />agents. <br />2. This permit is valid only for the equipment and/or operations <br />specifically identified herein. <br />3. Each and every condition of this permit is a material part hereof <br />and is not severable. Any challenge to, or appeal of, a condition <br />hereof shall constitute a rejection of the entire permit and upon <br />such occurrence this permit shall be deemed denied ab initio. <br />4. This permit may be denied or revoked by the Division far grounds <br />set forth in the Colorado Air Pollution Control Act and permit <br />regulations, including failure to meet any express term or condition <br />imposed therein upon or after final approval. <br />5. This permit must be retained and made available for inspection upon <br />request at the location set forth herein, and shall not be transferred <br />without approval of the 6ivision. <br />B. FINAL APPROVAL: <br />7. This Emission Permit does not provide "final" authority for operation <br />of this source, within the meaning of L.R.S. 1973, 25-7-112(4)(h), <br />until final approval is granted by the Division in writing. Final <br />approval cannot be granted until construction is completed and operation <br />and construction have been verified by the Division as conforming in all <br />• respects with the .~nditions'of this permit. <br />2. Before issuing final approval of this permit the Division reserves the <br />right to impose additional terms and conditions required to meet appli- <br />cable regulations of the Commission and Federal and state ambient air. <br />standards on a continuing basis. Monitoring and testing requirements <br />may also be imposed. <br />n <br />3. Failure of this source to obtain final approval within six (6) conths <br />of initial operation, as that term is defined by the Division, •will be <br />deemed a denial of the original application for emission permit and <br />shall be treated as a denial by the Division. <br />• <br />
