I have enclosed my revised Exhibits D, E, G-1, G-2, and G-3; these revisions were
filed with the Moffat County Clerk and Recorder yesterday, as evidenced by the attached
receipt. I will comment on the issues in your letter in order:
1. We have verified that the BLM was notified, and that I have consulted with
Jennifer Maiolo, geological engineer for the Little Snake Resource Area of the
BLM several times, including yesterday when I left her a package of the enclosed
revised Exhibits, and several other maps and exhibits for her file. The 4 W-drive
access does not appear to be an issue, however, she is aware of the 20-day
comment period, and will inspect the property in the next week or two to be sure
the proposed permit does not encroach on BLM. In addition, I have consulted
several times in the last few weeks with Lane Osborne of the Craig Office of the
State Land Board, and I also presented him with the revised Exhibits, and other
maps and exhibits - he has no problem with them!
2. I have attached a copy of the cover letter that I sent to Nathan Green at the
U.S. Army Corps of Engineers, 402 Rood Avenue, Room 142, Grand Junction,
CO 81501. As you can see, I sent him a copy of the amended Exhibits,
specifically Exhibits G-1, G-2, and G-3, as well as the Mining Plan, Reclamation
Plan and various other maps and exhibits related to topography and drainage on
the project.
3. The Amended Exhibit D at the top of page 2 states: "Overburden stockpiles
will be seeded with Moffat County's seed-mix formula when the soil types are
favorable for seeding, otherwise, the overburden piles will be shaped and
stabilized with water bars, berms and ditches. "
4. Your suggested lan° ~?ge for roads to be left for post-mining use is
incorporated in Exhibit E, items: 10, 1 I, 12 and 13. The local Land Board Office
approved this language.
5. The State Land Board does not want to define an absolute route for the 4W-
drive trail through the project. They will be working on a new transportation plan
for this area and they do not know what the future may hold for trails in the
Affected Area of the permit. We have addressed it by stating that we will consult
with the State Land Boazd before making any changes to any local trail in the
affected area.
