Box 580 State Engineer <br />Fort Coll <br />ns, Co 80522-0580 <br />i <br />RE: /Substitute Water Supply Plan Renewal, Timberline Pit, DRMS Permit No. M77-184 <br />Section 18, T7N, R68W, 6th P.M. <br />Water Division 1, Water District 3, Larimer County <br />Approval Period: May 1, 2007 through April 30, 2009 <br />Contact Phone Number for Ms. Susan Smolnik: 970-221-6700 <br />Dear Ms. Smolnik: <br />Your letter dated March 12, 2007, requesting renewal of the above referenced substitute <br />water supply plan to cover evaporation depletions for the Timberline Gravel Pit, has been reviewed. <br />The required fee of $257 for the renewal of this substitute water supply plan has been submitted. <br />The original plan was approved on March 19, 1992 and it was most recently renewed on May 20, <br />2005. <br />The anticipated net depletions for this plan are 54.5 acre-feet per year for a total of 23.5 <br />acres of lake surface exposed after December 31, 1980. According to the information submitted, <br />39.9 acres of water surface, out of a total of 63.4 acres exposed at the site, were exposed within the <br />reclamation permit boundary prior to January 1, 1981. A monthly breakdown of the annual <br />depletions totaling 54.5 acre-feet of evaporative loss was provided with this plan and is shown on <br />the attached Table I. <br />Mining at the Timberline Pit site has been completed and reclamation of the site will create <br />an unlined reservoirwith exposed ground water. On October 31, 2005, an application for a plan for <br />augmentation was filed with the Division 1 Water Court, in case no. 2005CW262, to include, but not <br />be limited to, long-term evaporation losses. Approval of this plan does not imply approval by this <br />office of any related litigation. <br />The proposed source of replacement water for this plan is 43.4 acre-feet of historical net <br />stream depletions from four shares of the Box Elder Ditch. The Box Elder Ditch shares from the dry- <br />up of approximately 222.7 acres of alfalfa, corn and pasture grass provide a dry year total of 223.7 <br />acre-feet of historical net stream depletions during May through October. The acreage dried-up will <br />need to be documented to the satisfaction of the water commissioner and division engineer. <br />Replacement for depletions during November through April, plus shortages during months with <br />insufficient credits will be met either from released water from Joe Wright reservoir or the City's <br />reusable effluent. A total of 11.1 acre-feet are required in addition to the 43.4 acre-feet of <br />
