<br />S S E T H
<br />desires to conduct a(n), open mining
<br />for the purpose of extracting open
<br />IdHEREAS, on September 30 1980 ,COLORADO DIVISION OF ~iIGHWAYS "FILED" an
<br />application,a reclamation plan and map, and the required fee, as required by law; and
<br />[WHEREAS, on October 23 1980 the Mined Land Reclamation Board approved
<br />COLORADO DIVISION OF HIGHWAYS application and set bond; and
<br />IdHEE&?5, on October 23 1980 the dined Land Reclamation Board accepted
<br />surety submitted by COLORADO DIVISION OF HIGHWAYS and such dace shall be considered the
<br />dace of issuance of the permit and the anniversary date for all other purposes; and
<br />GIHEREAS, the Mined Land Reclamation Board has made a finding, for the purposes
<br />of issuing this permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />`!fined Land Reclamation pct and all applicable l;gcal, state and
<br />Federal laws; and,
<br />2) the operation will not adversely affect the stability of anv
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred fee[ of the affected land, e:ccept where the-e
<br />is ar. agreement between the operator snd the persons having an
<br />interest in the structure that damage to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in confor,~7ance wiCh the requirements o° C.R.S. 1973, 34-32-116, as
<br />amended (1976 Sess. Laws H.3. 1060 ; and
<br />' idHEREAS, for the purposes of issuing this pe mit, the operator has ;Wade a
<br />satisfactory showing to the Board chat 'r.e t/i1i employ during and attar his
<br />open wining oneratior.s procedures reasona'o1y desi_ned to minimize
<br />as much as practicable the disruption from the open mining operations
<br />and will provide for the rehabilitation of the affectec land through the rehabilitation
<br />of plan[ cover, soil stabili[;~, water resources, ana other measures appropriate co the
<br />subsequent beneficial use of such wined and reclaimed lands; and that in the event
<br />of the failure of his proposed reclamation plan, he will take •:hate•Jer measu-es •,:hich~
<br />may be necessary in order to assure the success of reclamation of the lands offected
<br />by hip open mining operations; and,

<br />[o this permit and therzby becomes a part o the [arms hereof.
<br />SO L1, TY.EREFO RE, pursuant to the authority sat forth in the Colorado >Sined
<br />Land Reclamation Act, article 32 of Title 34, C.R.S. 1973, as amended, (1976
<br />Sess. Taws H.3. 106i) the `lined Land Reclamation Board of the Stale of Colorado
<br />hereby issues a life r the mine pe.rmic to COLORADO DIVISIDN OF HIGHIJAYSto en~a_>a
<br />in open mining far the purpose of extracting open
<br />mined sand & gravel on the following parcel of ground, to wit:
<br />SW 1/4 NE 1/4 Section 7.7, T. 40N, R. 4[; NMPM,
<br />Rio Grande County, Colorado.
