The general permit for coal mining discharges is very specific <br />as to what discharges are covered and what discharges are excluded from <br />coveracxe. It does not cover discharges of mine water. <br />The discharges you are proposing are included under the definition of <br />mine water because the runoff and groundwater have been in contact with <br />an active mining area. For this reason, they cannot be covered under <br />the current general permit certification. Kerr Coal Company will need <br />to apply for an individual permit for these discharges. <br />It is logical to cover the entire site under one permit, thus we would <br />propose to include the currently authorized discharges under the new <br />individual permit. The current general permit certification would be <br />inactivated upon issuance of the individual permit. <br />We are including a permit application with this letter. Please include <br />both the proposed new discharges and the existing discharges in the <br />application.
