Permit 11odification <br />After notice and opportunity for a hearing, t:`~r permit may be n~~odified, <br />suspended, or revoked in t-hole ur in part durir•q its Conn for cause including, <br />but not limited to, the follo~:inn: <br />(A) Violation of any terms or conditions of phis per;uiC; <br />(B) Obtaining Chic permit by misrepresent,~tion or failure to disclose <br />fully all rele~~nnt facts; <br />(C) A change in any condiCion which result; in a Le mhorary or permanent <br />reducCion, elimination, addition or increase of the perinitled discharge. <br />- (Changes in l•later Quality SCandords, control regulation or duly proinulnated <br />plans would quality as "a change in any condition."); <br />(D) This permit shall be modified, or alternatively, revoked and reissued, to <br />cornply with any applicable effluent standard or limitation issued or approved <br />under sections 301(b)(2)(C), and (D), 304(bj(2), and 307(a)(2) of the Clean <br />iaater Act, if [he effluent standard or limitation so issued or approved: <br />(1} Contains difftront conditions or is other•.aised more stringent than <br />any zffluen[ limitation in tf~•e permit; or <br />(2) Controls any pollutant not limited in the permiC. <br />The permit as modified or reissued under [his paragraph shall also contain <br />any other requirements of the Ac[ [hen applicable. -or- <br />(E) Changes and additions in control regulations. <br />(F) Data submitted persuanC Co Part I.A. 2 of this permiC indicates a <br />potential for violation of instream o-iater quality standards and/or <br />established classifications and numeric standards. <br />6. Toxic Pollutants <br />Notwithstanding "Permit Modification", paragraph B-5 (above,l, if a toxic <br />efflucnC standard or prohibition (including any schedule of compliancz <br />_ specified in such effluent standard or prohibition) is established under <br />- - Section 307(a) of the Act fora toxic pollutant which is present in the <br />discharge and such standard or prohibition is more stringent than any <br />limitation for such pollutant in this permit, this permit shall be revised <br />or modified in accordance ~•rith the toxic effluent standard or prohibition <br />and the permittee so notified. <br />7. Llivil and Criminal Liability <br />Except as provided in permiC conditions on "Bypassing" (A-2-(C)) and <br />"Reduction, Loss, or Failure of Treatment Facility", (A-7), nothing in this <br />permit shall be construed to relieve the permittee from civil or criminal <br />penalties for noncompliance. (See Fed. Reg. Vol. 454 No. 98, 122.60). <br />8. Oil and Hazardous Substance Liability <br />Nothing in this pzrmit shall be construed to preclude the insCitution of any <br />legal action or relieve the permittee from any responsibilities, liabilities, or <br />penalties to which the permittee is or may be subject under Section 311 of the Act <br />5/81 <br />s- <br />
