6.4.16 EXHIBIT P - Municiualities Within Two Miles
This section is adequate as submitted.
6.4.17 EXHIBIT O -Proof of Mailing of Notices to County Commissioners and Soil
Conservation Aistrict
This section is adequate as submitted.
6.4.18 EXHIBIT R -Proof of Filing with County Clerk aed Recorder
This section is adequate as submitted.
6.4.19 EXHIBIT S -Permanent Man-Made Structures
The list of structures includes some livestock fences for which an agreement will also be
needed. In addition, the stock tank, although seemingly abandoned, may be used
seasonally. Also, it was not clear whether or not there was an underground waterline
used in conjunction with this tank. In either case, a letter clearing stating that the tank
and/or waterline are abandoned should be submitted or a damage agreement for these
structures provided. Also, with respect to keeping the affected azea of the operation at
least 200 feet away from any structure prior to obtaining agreements or conducting an
engineering analysis, please remember that the access road is considered affected azea, so
these agreements will need to be in place prior to initiating construction on your site
access. If these agreements are not provided prior to making a decision on this
application, the maps should be revised to show that no affected azea is within 200 feet of
an identified structure.
This concludes the Division's preliminary adequacy review of this application. Please
remember that the decision date for this application is May 16, 2006. As previously
mentioned if you are unable to provide satisfactory responses to any inadequacies prior to
this date, it will be your responsibility to request an extension of time to allow for
continued review of this application. If there aze still unresolved issues when the
decision date arrives and no extension has been requested, the application will be denied.
If you have any questions, please contact me at (303) 866-4926.
Si cerely,
/~W_
Anthony J. aldron
Environmental Protection Specialist
Cc: Maureen Jacoby-Banks and Gesso
Enclosure(s)
