Simpson, P.E. <br />State Engineer <br />RECEIVED <br />~UG 2 7 2004 <br />Division ~f Minerals and Geology <br />We have received your request of August 9, 2004 requesting approval of the above referenced <br />substitute water supply to cover depletions caused by an existing gravel mining operation. The required <br />fee of $217.00 for this substitute supply plan has been submitted. <br />The proposed supply plan is to replace depletions caused by evaporation from up to 48 acres <br />of water surface exposed after December 31, 1980 and the removal of water in product. According to <br />the information submitted no water surface was exposed prior to January 1, 1981. The City of <br />Brighton will line the pit with a slurry wall by the end of 2004. Once the pit is lined the area of <br />evaporation is predicted to decrease. The plan estimates that the area of evaporation will be 48 acres <br />for August through December and will then decrease to 10 acres for the remainder of the plan period. <br />Consumptive use of water at the property consists of 69.4 acre-feet of evaporation from the <br />maximum 48 acres of exposed pond area and 23.6 acre-feet lost in product (4% moisture of 800,000 <br />tons of raw material). No phreatophyte credit has been applied to this plan. The monthly lagged <br />depletion and replacement requirements are found on the attached table. Since the depletions have <br />not yet reached steady state conditions the lagged depletions total 91.8 acre-feet. <br />The source of replacement water for this plan consists of 54.8 acre-feet per year of leased fully <br />consumable replacement water from Consolidated Mutual Water Company ("Consolidated")and 39 <br />shares of Fulton Ditch. Of the 54.8 acre-feet of lease water from Consolidated approximately 3.3 acre- <br />feetwill cover transit losses (0.5% per mile for the 13 miles from Metro Wastewater plant outfall to the <br />Bromley Lakes Pit). The 39 shares of the Fulton Ditch were historically used to irrigate 77 acres of <br />alfalfa and grass. Assuming a 20% ditch loss and a 65% irrigation efficiency, the dry-year <br />consumptive use of the 39 shares was determined to be 68 acre-feet. A portion of the Fulton water <br />will be recharged back to the stream through the pit and a portion will be delivered directly back to the <br />river. <br />I hereby approve the proposed substitute water supply plan in accordance with C.R.S. §37-90- <br />137(11), subject to the following conditions: <br />1. This plan shall be valid through July 31, 2005 unless otherwise revoked or modified. If this <br />plan will not be made absolute by a water court action by the plan's expiration date, a renewal <br />
