Please clarify this matter. <br />Exhibit D <br />1. Wildlife: The deficiencies noted by the Division of Wildlife will be <br />expanded upon in this letter under Exhibit E. <br />2. Soils, Vegetation, and Water Resources <br />a. The S.C.S. letter notes "numerous springs and seeps" needing <br />diversion around the proposed mining operation to avoid sedimentation to <br />the adjacent streams. Please describe your plans for such diversions. <br />Exhibit E <br />il. There is no real reclamation plan for this site as the application is <br />presently constituted. The end land use of "fish ponds" is not accomplished <br />Jby your plan. The real end land use of potential fish ponds is not a <br />beneficial land use under our Act. Thus, I feel that the operator and the <br />landowner should agree to a reclamation plan. I will expand upon this below. <br />2. If the pit is to be left dry, a dryland reclamation plan should be <br />committed to by the operator. This would include replacement of topsoil (a <br />depth to be committed to by the operator) over the entire pit area (and other <br />disturbed areas) and application of the revegetation plan given to us on the <br />CO-ECS-S form by the S.C.S. The slopes of the pit margins in this case should <br />not exceed 3H:1V for revegetation success. <br />3. If the fish ponds area actually to be constructed, a plan for them must be <br />submitted and their construction completed before reclamation can be <br />considered complete. In this case, topsoil (to some given depth) should be <br />replaced on the shore areas and other disturbed areas, and the S.C.S. <br />revegetation plan should again be implemented on all non-pond areas of the <br />permit areas. In this case, pond margin slopes should conform to Rule 6.1(f ), <br />or a maximum steepness of 2:1, except from 5 feet above to 10 feet below the <br />expected water line where the maximum is 3:1 (horizontal to vertical). <br />4. Given the depth of surface topsoil is at least 16 inches, I recortunend that <br />the operator commit to replacement of at lease 12 inches of topsoil in <br />reclamation. <br />5. Given the end land use of fish ponds, and the comments by the S.C.S., I <br />assume that the operator will commit to planting willows and cottonwoods <br />around the pit margins. Please clarify the plans in this regard. <br />6. Location of either reclaimed dry pits or fish ponds should be shown on the <br />map. <br />Exhibit F <br />1. Reference my comments above concerning local zoning approval. <br />
