The oversized material will be stacked am_t used to <br />backfill the first pit when sufficient room is available. <br />The map in Exhibit C indicates this temporary location as <br />'waste Rock." <br />The eater impourxlment will be below grade with dimensions <br />of approximately 20' x 40' x 10.' The dozer aryl front-end <br />loader will push the material out of the hole. This material <br />will be run through the tromnel and stacked for later back- <br />filling, <br />4. A 100' buffer will be left between the high water mark and <br />the pit. Stakes will delineate the boundary. <br />5. Reclamation will be concurrent with mining. However, the <br />material from the first pit cannot be backfilled until the <br />first pit is mined to its maximum depth. After the first <br />year of operation, the material will be backfilled directly <br />into the mined areas. <br />6. An existing small diversion ditch above the proposed opera- <br />tion will be lengthened to intercept and divert runoff away <br />from the disturbed area. Runoff water cannot be captured <br />because it has previously been allocated to water users with <br />existing water rigtits. <br />Addii;ional berms or ditches will be built as necessary to <br />divert runoff away from disturbed ground. <br />7. Texas Mining & Exploration Co. submitted a statement, ack- <br />nowledged by a notary public, that the operator has a legal <br />right to enter and mine.
