Cattany <br />Division Director <br />Na[ual Resource Trustee <br />The Division of Minerals and Geology has completed review of the 3b and 4~' quarter 2003 <br />sediment pond inspection reports for the Raton Creek mine, #C-82-055. <br />Each inspection report demonstrates compliance with Rule 4.05.9(17) for impoundments. <br />Observations are consistent with field observations noted during Division inspections periodically <br />throughout the year. <br />However, review of the file and these reports reveal that none of the inspection reports for 2003 <br />meet the annual inspection and reporting requirement of Rule 4.05.9(14) and (15) regarding the <br />depth and elevation of any impounded water and the existing storage capacity (both sediment <br />and water) of the impoundments at the time of the inspection, as certified by a registered <br />professional engineer. Although a registered P.E. has certified the 4'" quarter report, the report <br />lacks the information required by Rule. Depth and elevation of any impounded water and the <br />existing storage capacity for both sediment and water were not documented in the report. <br />Additionally, the report does not clearly state that the "impoundment has been... maintained as <br />designed, and in accordance with the approved plan and the applicable regulations." Please <br />refer to Rule 4.05.9(14) and (15). Please submit the required information within 30 days of <br />receipt of this letter. <br />We have no further questions or comments at this time.
