The subject report was transmitted on February 18, 2002 and received at the Division on
February 22, 2002. The inspection was conducted on December 20, 2001. This review is
conducted to determine compliance with Rule 4.05.9(14).

Rule 4.05.9(14) All impoundments shall be inspected by a qualified registered professional
engineer or other qualified professional specialist under the direction of a professional engineer.
The professional engineer or specialist shall be experienced in the construction of
impoundments.
The inspection was conducted and the report certified by a professional engineer.
Rule 4.05.9(14)(a) Such inspections shall be made regularly during construction, upon
completion of construction, and at least yearly until removal of the structure or release of the
performance bond.
This inspection was a yearly inspection, pending removal of the structure. The structure was
removed in late December, 2001.
Rule 4.05.9(14)(b) The qualified registered professional engineer shall, promptly after each
inspection required by 4.05.9(14), provide to the Division, a certified report that the
impoundment has been constructed and/or maintained as designed, and in accordance with the
approved plan and the applicable regulations.
The certified report contains a statement that the pond was constructed and maintained as
designed in accordance with the approved plan and the applicable regulations.
