Lochhead <br />Executive Duedor <br />Michael B. Lang <br />Division Direuor <br />The Division received your package of sulfur data dated February 21, 1997 (CC&V letter from <br />J. Hardaway to B. Keffelew). These data were reviewed with regard to the permit conditions that <br />relate to disposition of waste rock from the Cresson Pit. <br />The sulfur data aze listed by x-y-z coordinates of the "standard mining unit" from which each <br />sample was collected. However, the data are not keyed to any location because you did not <br />provide the grid key of the Cresson pit. More importantly, the data do not verify where any <br />standazd mining unit of waste rock was deposited. As received, these data alone are not adequate <br />to the Division for making essential determinations about the disposition and handling of waste <br />rock. <br />This letter outlines several steps that CC&V must take to verify compliance with the permit <br />conditions and with the Mined Land Reclamation Act. <br />Section S.17 of the Cresson permit states that waste rock with greater than 0.8% sulfur will be <br />underlain by rock with neutralizing potential, and that if, at the time of placement, alkaline rock <br />has not been placed below the area of dumping, then lime will be spread under the dump area <br />and/or mixed with the acid-producing rock. The Division has received no verification that <br />1 <br />
