• "pcrccnt change from one year ago" as is available in <br />the most recent publication as of July 1, 1982, <br />reporCs a change of 10.0 percent, the price being paid <br />prior to July 1, 1982 shall then increase for the next <br />twelve months by 10% (.10 X .275 = .0275, then .275 + <br />.0275 = .3025). Subsequently, the royalty for Che <br />period July 1, 1983 to July 1, 1984 shall be <br />determined by the percent change revealed in the most <br />recent publication avail-able on July 1, 1983 applied <br />to the figure 5.3025. Each July 1 thereafter, the <br />royalty shall be recomputed in the same manner. <br />E. The royalty determined as provided herein shall <br />be applicable to all of the Leased Premises for which <br />this Lease Agreement shall be effective. <br />13.(a) In the event that Lessee is successful in <br />obtaining the necessary permits to mine sand and gravel <br />in the portion of the Leased Premises located in Section 35, <br />as provided hereinabove, Lessee shall pay to Lessor an <br />advance royalty of 828,000 within thirty (30) days after <br />the lease becomes effective as to the lands within <br />Section 35. Lessee shall make additional advance royalty <br />payments six months after each annual anniversary of 'the <br />first advance royalty payment; the amounts of such advance <br />royalties being: (i) six months after the first <br />anniversary, 120,000 X the per ton royalty as of the <br />preceding July 2; (ii) six months after the second <br />anniversary, 140,000 X the per ton royalty as of the <br />preceding July 2; (iii) six months after the third <br />anniversary, 160,000 X the per ton royalty as of the <br />preceding July 2; (ivj six months after the fourth <br />anniversary, 180,000 X the per ton royalty as of the <br />preceding July 2; and (v) six months after all subsequent <br />anniversaries, 200,000 X the per ton royalty as of the <br />immediately preceding July 2. <br />(b)Plot:rithstanding the provisions contained in <br />Subparagraph 13(a). Lessee shall annually pay to Lessor the <br />smaller of the following amounts: (i) the specific annual <br />amount recuired by the provisions of Subparagraph 13(a) or <br />l (ii) an amount equal to the cumulative total of the advance <br />royalties due to such date (as recuired by Subpara- <br />graph 13(a), less the cumulative total to date of all <br />r <br />-5- <br />
