'this Lease /~.grccm~nt shall remain in full <br />force and effect, for the purposes of mining and extraction <br />of sand and gravel, until midnight on August 30, 1988; <br />provided, however, if the Lease Agreement does not become <br />effective as to the Section 35 land within twelve (12) <br />months from the date of this Agreement, it shall remain in <br />effect only for such period of twelve (12) months. Lessee <br />shall have a period of 180 days from the termination of the <br />Agreement within which to remove any materials stockpiled <br />on the Leased Premises and an additional 60 days to perform <br />any reclamation work. <br />8. All of the work which may be performed by Lessor <br />during the term of this Agreement shall be performed in <br />a good and workmanlike manner. Lessee shall conduct its <br />business on the Leased Premises in accordance with each <br />and every requirement of the Colorado Mined Land Reclamation <br />Board and all other governmental agencies or departments. <br />Moreover, Lessor shall satisfy all obligations for reclam- <br />ation of the property, agreeing: (a) to submit to Lessors, <br />at least ten (10) days prior to submission to the Colorado <br />Mine Land Reclamation Board, all reclamation plans and <br />maps, (b) to restore the floor of any pit to a condition at <br />least as level as existed on the date of this lease and the <br />slopes from the pit limits to the original ground level to <br />a uniform grade and (c) not to dump any trash or other <br />materials on the Leased Premises which would hinder <br />• residential development of the property. <br />9. Lessors are in the process of quieting title to <br />the sand and gravel underlying the portion of the Leased <br />Premises located in Section 35. Lessee and Lessor shall be <br />excused from all obligations under this Lease relative to <br />property located within Section 35 unless: (a) this <br />litigation terminates in favor of Lessors or (b) all the <br />individuals or entities determined to be the owners (by <br />Court order or settlement stipulation) approve of this <br />Lease in writing.
