DALE FOSTER, whose address for <br />purposes of this Agreement is 2345 N. 7th Street, Grand <br />Junction, Colorado 81501, hereinafter referred to as <br />"Lessor", and COP,N CONSTRUCTION CO., a Colorado CC <br />corporation, whose address for purposes of this Agreement <br />is P.O. Box 1240, Grand Junction, Colorado 81502, herein- <br />after referred to as "Lessee" <br />RECITALS <br />A. Lessor is the owner of property within the SE} of <br />• <br />the SEA of Section 34, and the E'-z SW'-~ and SW'-~ SW'-~ of <br />Section 35, Township 1 South, Range 1 East of the Ute <br />Meridian, Mesa County, Colorado. <br />B. A portion of the property contains sand and <br />gravel and the parties desire to execute this Lease so that <br />Lessee may extract such sand and gravel. <br />nr_occrtrtz~n.m <br />NOW, THEREFORE, the parties agree: <br />1. Lessor hereby grants unto Lessee, subject to the <br /> <br />terms of this Agreement, the exclusive right to enter upon <br />the portion of the real property depicted on the map <br />attached as Appendix A (hereinafter "Leased Property") to <br />extract, process and remove thereform sand and gravel in <br />accordance with the terms hereof. <br />2. Lessor presently holds a permit from Mesa County <br />and the Colorado Mined Land Reclamation Board for the <br />extraction of sand and gravel from that portion of the <br />Leased Premises lying within said Section 34. The parties <br />shall cooperate and execute such documents as may be <br />reasonably necessary to permit the Lessee to extract the <br />sand and gravel pursuant to said permits and to transfer <br />the said permits to the Lessee. The parties shall also <br />cooperate to permit substitution of the Lessee's bond for <br />any bond which may have been posted by Lessor. <br /> <br />
