The issuance of the <br />permit does not assure the applicant that no injury will occur to another vested water right or preclude another <br />owner of a vested water right from seeking relief in a civil court action. <br />2) The construction of this well shall be in compliance with the Water Weil Construction and Pump Installation Rules <br />2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well <br />Construction and Pump Installation Contractors in accordance with Rule 17. <br />3) The Denial AD-12872 LS reversed and the permit Is approved pursuant to CRS 37-90-137 (2) and (11) for the <br />construction and operation of a well (gravel pit) in accordance with the temporary substitute water supply plan for <br />the 83rd J.V. Resource Pit (Beltway Paving) approved by the State Engineer on January 24, 1994. The well (pond) <br />shall not be operated unless it is included in a substitute water supply plan approved by the State Engineer or a <br />plan for augmentation approved by the Water Court. The water suppy plan for this pit is currently valid through <br />December 31,1994 and it it is not extended or if a court decree is not entered for a plan for augmentation, this well <br />permit is null and void and all use of the water must cease immediately. <br />4) The average annual amount of ground water to be appropriated shall not exceed 14.58 acre-feet with the total <br />surface area of the proposed ground water pond limded to 0.95 acres. <br />5) The owner shall mark the well (gravel pit) in a conspicuous place with well permit number(s) and court case <br />number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. <br />6) The use of ground water in addRion to evaporation, is limited to water carried off in the product, and dust <br />suppression. No other use of water is allowed unless a permit therefor is approved. <br />7) The provision of the Minimum Construction Standards in Rule 10 shall be waived for gravel pit wells except for <br />Rules 10.1 and 10.2.1 regarding aquifer contaminarrts.
