Reclamation Permit Exhibits
Dear Mr. Million:
On November 9, 1994, the Division of Minerals and Geology received the amended
information for your application package for the Spring Ck Gravel Pit, File
No. M-94-097. One item must still be submitted before the Division can
consider your application ae submitted. You must still submit a receipt or an
affidavit from the Montrose County Clerk and Recorder stating the date on
which they received the application and amended information for public review.
The Division has also noted an error in Exhibit A - Legal Description. You
stated that the site is located in the 6th Colorado Meridian. The copy of the
Special Warranty Deed submitted in Hxhibit O - Source of Legal Right-to-Enter,
states that the location of the land ie in the New Mexico Principal Meridian.
The Division also received a letter from the Montrose County Clerk and
Recorder Ms. Ruth Heath, stating that she had not received your application
but had read your initial public notice and found the legal description to be
in error. Please submit an amended Exhibit A to the Division. You must also
give the amended fixhibit A to the Montrose County Clerk and Recorder and
request that they give you a receipt for the change to be submitted to the
Division.
You may amend the application by submitting the requested items. in
accordance with Rule 1.8, a decision date will be established 90 days from the
date of receipt of all requested items. You will need to republish notice
which specifies the final date for receiving comments is the 20th day after
the fourth publication or the next regular business day.
This letter shall not be construed to mean that there are no other technical
deficiencies in your application. The Division will review your application
to determine whether it ie adequate to meet the requirements of the Act after
submittal of all required items.
