Box 75 <br />Pueblo, Colorado`81002 <br />Re: Mined Land Reclamation Board Gravel Pit Application <br />Evans Pit #2 -Western Mobile Southem, Inc. <br />Dear Mr. Marquez: <br />Western Mobile Southern, Inc., a subsidiary of Lafarge Corporation is applying for a gravel <br />mining permit from the Mined Land Reclamation Board for a permit on property that is <br />south of U. S. Highway 50 and just west of Nyberg Road in Pueblo County (see the attached <br />Index Map). This pit is to be called the Evans Pit #2. The parcel of land is in a portion of <br />Section 35 and a portion of the W % of Section 36 in Township 20 South, Range 63 West; <br />and in a portion of the W '/z of Section 1 and a portion of the E'/~ of Section 2 in Township <br />21 South, Range 63 West, as indicated on the attached Mining Plan Map <br />WestPlains Energy has power lines that run north/south along Nyberg Road and cross over <br />the southeast corner of the permit area. However, the lines are crossing over anon-mining <br />buffer zone, which we would like you to be aware of, as they do fall within our permit <br />boundary. <br />Rules and Regulations of the Colorado Mined Land Reclamation Board effective January <br />1996 and atnended in April 1999 in rule 6.4.19 Exhibit "S" -Permanent Man-made <br />Structures, read as follows: <br />"Where the mining operation will adversely affect the stability of any significant, valuable <br />or permanent man-made structure located within two hundred (Z00) feet of affected land, <br />the applicant may either: <br />(a) pruvide a nutarizcd agrcciuci~i Letwccu tl,. applicant and the p~rsct(s) hay it:; : n interest <br />in the structure, that the applicant is to provide compensation for any damage to the <br />structure; or <br />"Your Brand of People" <br />
