We
traveled out to the pasture land that is irltended to be devebped into the Line
Camp Gravel Pit. The area is pasture land. To the north of the pasture is an
irrigation delivery ditch running along the highway 145 easement edge. Qn the
southerly portion of the pasture is a riparian wooded area that separates the
pasture from the Dolores River. On the east side of the pasture Is another
property with a residential structure. To the west of the pasture is an empty
wooded area that separates the pasture from the resldentlal house further to the
west. The wooded area may contain wetlands; ft Is too early in the season to
determine the dominant vegetative growth. The pastured land contains very
shallow depressions where water from the irrigation of the field collects. These
areas may contain wetland vegetation, however the water that collects Is very
obviously surface irrigation supplied.
Mr. Truelson stated that all of the gravel mining activity will be restricted to the
pastured area. There will be a haul road created between the mined area and
the existing edge of woods to the south. The mining activity to the east and to
the west will terminate within the pasture. The mining acWity to the north w01
terminate before reaching the irrigation dftch. I asked Mr. Truelsan If a berm will
be constructed for visual purposes between the hghway and the mining area.
He stated that the overburden will be pieced along the west side of the mining
area to provide a buffer for the adjacent neighbor. There would not be a bens
placed along the highway. Mr. Truelson stated that the work area will be visible
from the highway whether a berm is placed there or not
All of the water that will be used for washing the gravel will be treated prior to
disposal into the Dolores River. I explained to Mr. Truelson that if any
appreciable sediment Is discharged into the river, that provides a juriadictional
handle for Section 404 of the Clean Water Act, and It would be a violation of the
Clean Water Act. He stated that sediment Would be properly controlled, and only
clean water would be discharged Into the river.
I stated to Mr. Truelson that I did not see any activity they will engage in that
would be jurisdictional under Section 404 of the Clean Water Act.
Nicholas A.
