We have revised the Reclamation Cost Estimate and <br />enclosed for your review. <br />6.4.14 EXHIBIT N -Source of Leval Riaht to Enter <br />24. As described on page 1 of this letter, the updated legal description for the permit boundary is <br />enclosed for your reference. The mining permit boundary encompasses all of the property <br />described as: "A parcel of land being all that part of the SE'/, and part of the E'/z SW'/4 of <br />Section 12, Township 5 North, Range 65 West of the 6~ P.M., County of Weld, State of <br />Colorado." And a portion of the property described as: °Lot B of Corrected Lot B of 2~d <br />Amended Recorded Exemption No. 0961-12-4-RE1053, recorded July 11, 2001 as Reception <br />No. 2864757, being a part of the SE Y, of Section 12, Township 5 North, Range 65 West of the <br />6~ P.M., County of Weld, State of Colorado." <br />Both parcels are owned by Water Resources, LLC and the legal right to enter included in the <br />application gives Hall-Irwin Corporation the right to enter into both parcels. <br />25. Our response to this item will be submitted within the week. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />26, The Stability Analysis originally submitted is a conservative analysis based on the use of <br />conservative strength parameters in the modeled profile and is consistent with analysis <br />requests made by DMG personnel on past submittals. Due to the conservative strength <br />parameters utilized in the analysis, the factor of safety generated should be acceptable and <br />provide reasonable assurances that nearby structures will not be harmed by site mining <br />activities. <br />Kirig Surveyors provided the base map for this project. The survey map designated <br />"approximate" on the underground utility locations. The pipes are shown within the legal <br />easements, or as surveyed by pipe location markers provided by the utility companies. The <br />language on the Mining Plan states that the setbacks are based on the stability analysis <br />requirements, and that all underground utilities shall be located prior to mining. This note <br />ensures the setback requirements will be satisfied should the exact location of the pipes vary <br />and should the slurry wall location need to be adjusted during final design. <br />27. Please refer to item 7 on page 2 of this letter. We have also enclosed the Oil and Gas <br />Facilities - Existing Conditions, Mining and Reclamation Plans far your reference. <br />28. Based do the regulations, Hall-Irwin submitted a Stability Analysis to satisfy the requirements <br />of 6.4.19; therefore notarized structure agreements are not required. <br />29. As required by Rule 1.8.1, this letter and enclosures will be submitted to the Weld County Clerk <br />to fhe Board of County Commissioners office. A signed affidavit from the Clerk's office will be <br />forwarded via fax to the Division. <br />
