The tension cracks mentioned in the reference <br />order are cracks from loss of moisture and after thorough <br />investigation were found to be superficial only, the cracks being <br />only two inches in depth, randomly oriented, and not of significant <br />length. The nature of construction methods required for this type <br />of structure would contribute to the types of cracks observed. <br />There was no evidence of stress or tension cracking, bulging, <br />sliding, or seepage. We expect the most recent precipitation and <br />subsequent warm weather produced the condition. <br />Landmark is confident that the pond is sound as certified and <br />that no additional excavation is required at this time. We wish to <br />resolve this issue as soon as possible, certainly prior to April <br />23, 1993, and would appreciate access to any documents or <br />information supporting the order and rebutting the certification. <br />We believe the issue can be resolved and the order vacated <br />with some discussion and explanation, and request an informal <br />hearing to do so at your earliest convenience.
