III 1111111111111111 <br />999 <br />• s ~ 2.04.12 PRIME FARMLAND INVESTIGATION <br />In order to determine whether or not prime farmlands, as defined in <br />Section 1.04 (95) of the Colorado Regulations, exist within the Southfield <br />permit area, Dorchester as the previous operator, conducted reconnaissance <br />investigations. The results of these investigations are included in <br />Exhibit 13, Prime Farmland Investigations. Dorchester found that none of <br />the disturbance areas are within areas designated as prime farmlands by <br />the USDA-SCS and the Colorado State University Experiment Station. <br />Additionally, it was determined that no lands within the Southfield permit <br />area are currently or have historically been utilized as cropland nor do <br />they contain soil mapping units, as defined in Section 7CFR 657 (Federal <br />Register, Vo1.4, No. 21), considered to be indicative of prime farmland <br />conditions. <br />Since all available information indicates that no lands within the <br />• Southfield permit area qualify as prime farmlands as defined in Section <br />1.04 (95), Dorchester requested and received a negative determination for <br />the existence of prime farmlands on all lands addressed by this permit <br />application. This negative determination is set forth on page 29 of <br />Exhibit 14, Proposed Decision and Findings of Compliance. <br />• <br />2.04.12-1 <br />
