Enclosed are two copies, as you requested, of American Soda's 17th Quarterly Report in
compliance with Hard Rock Mining Operation Permit No. M-99-002. One copy of the
document is not bound. This document includes environmental ground water monitoring
data collected and compiled during our seventeenth quarter of operations, October 1, 2004
through December 31, 2004. No solution mining activity occurred during the report period.
Although the CDMG had approved a technical revision permitting modifications to the
monitoring program, EPA approval of the modifications is anticipated sometime during the
first quarter of 2005. Until all agency approvals are finalized, monitoring and reporting will
be conducted as detailed in the original monitoring plan.
The ground water data summary report is spiral bound as anon-confidential document and
includes a comparison of the 17th operational quarter with baseline and operational
general statistics prior to the current reporting period. In addition, the tables provide
information for comparison of Ground Water Standards as provided in Regulation No. 41
of the Colorado Department of Public Health and Environment Water Quality Control
Commission and Numeric Protective Levels and Early Warning Indicators.
Comparison of the data values with the Early Warning Indicators (EWI) and the Numeric
Protective Levels (NPL) is showing some values above the established limits. These
values are summarized in Table 1 and highlighted in red in each of the summary tables
within the document. Included in the Executive Summary of the Ground Water document
are graphs illustrating the locations and constituents that are elevated above the
established Early Warning Indicators or Numeric Protective Levels. These graphs include:
