Elk Creek Mine. <br />Dear Ms. Watson: <br />Enclosed are the October 2006 Dischazge Monitoring Reports (DMA's) for the Oxbow Mining, LLC, <br />(OMLLC) Elk Creek Mine. <br />The enclosed DMRs indicate dischazges from Outfalls 012 and 016 which exceeded the primary effluent <br />limitations for total suspended solids (TSS) and total iron. In accordance with the October 24, 2004 <br />Permit Amendment No. I, Permit Part II Alternate Limitation Burden of Proof Requvements, the request <br />for relief of primary total suspended solids (TSS) and total iron limitations are attached herein for the <br />Division's consideration. Due to discharges caused by precipitation from a less than 10-yeaz, 24-hour <br />precipitation event(s), OMLLC is requesting a determination of compliance with the permit "Alternate <br />Limits." <br />No other issues were encountered during October 2006. <br />If you have any questions or comments, please contact me at (970) 929-5806. <br />Sincerely, <br />~.~~~~ <br />James A.
