EXHIBIT F <br />SOURCE OF LEGAL RIQiT TO ENTER <br />Page 3 <br />Lessee will pay to Lessor as royalty $.30 for each cubic yard of materials <br />removed from the premises. Lessee will forward to Lessor monthly reports <br />showing the quantity of materials removed during the preceding month <br />according to truck loads, with dates of loading. Each report will be <br />acccxnpanied by a check from Lessee to Lessor for payment of the preceding <br />month's material. <br />Lessee may clear brush and undergrowth from such portions of the leased <br />premises as may be reasonably necessary to explore for materials or to locate <br />pits, quarries and stockpile areas. Lessee will have the right to make use <br />of all roadways presently existing on the leased premises and will have the <br />further right to build such additional roads as may be necessary for the <br />production and removal of materials hereunder. <br />In digging pits for the purpose of producing and removing materials <br />hereunder, Lessee agrees to make separate stockpiles of topsoil and of waste <br />substances. Lessee agrees that, upon the crnq~letion of the removal of <br />materials from the pits that have been dug on a leased premises, Lessee will <br />place any unused waste substances and materials used for roadways back into <br />the pits from which such substances and materials were removed with topsoil <br />placed on top, and Lessee will back-slope such pits using such substances and <br />materials as have been removed from such pits. The restoration of the surface <br />will be in accordance with the rules and regulations pra[ailgated by the <br />Mined land Reclamation Board of the State of Colorado. <br />In the event of any default in the performance of any term or condition of <br />this Lease by Lessee, Lessor will have the right to give a 30-Kiay notice in <br />writing to Lessee demanding the correction or removal of such default. In the <br />event that Lessee fails to correct or remove such default within such period, <br />Lessor may, at her option, terminate this Lease. <br />This Lease will inure to the benefit of and will be binding upon the heirs, <br />legal representatives, successors and assigns of the parties. <br />IN WITNESS WHEREOF the parties have executed this agreement the day and year <br />first above written. <br />LESSOR: <br />LETHA.I'7.
