The application was initially deemed inadequate for lack of a performance <br />warranty, which was subsequently submitted on Mazch 2, 1998. The application was then called <br />complete and assigned a decision date of April I, 1998. <br />Overall the application is well organized and substantially addresses the requirements of rule 6.3 <br />of the Construction Materials Rules and Regulations of the Colorado Mined Land Reclamation <br />Boazd. One area that is inadequate is under Exhibit C- Mining Plan, 6.3.3(6). This regulation <br />requires that the operator specify how topsoil will be stockpiled and stabilized with a vegetative <br />cover until used in reclamation. The application indicates that this pit will be open for <br />approximately 10 years and the mine plan indicates that approximately 5 inches of topsoil will be <br />salvaged and stockpiled in a designated area as shown on the Mine Plan Map. The mine plan <br />states that a cover crop of oats will be used to stabilize the stockpiled topsoil, however, oats is an <br />annual grain that will only provide temporary stabilization. Since the topsoil stockpile will be in <br />place for up to 10 years, it should be seeded with a perennial grass mixture that will provide <br />stabilizing cover for the entire length of time that the pile will be in place. Typical temporary <br />mixtures usually include one or two wheat grasses (preferably not crested wheat grass), smooth <br />brome and possibly a warm season grass such as sideoats grama. Please select a suitable mix for <br />your area and provide the Division with a copy of your revised topsoil stockpile seed mix. <br />Enclosed with this letter is a copy of a Department of the Amoy, Corps of Engineers letter that <br />the Division received indicating that a 404 permit would not be required for this reclamation <br />permit. The Division has not received any other correspondence concerning this application <br />from the public or other commenting agencies. Since we do not have any other concerns with <br />this application, once we receive and approve the topsoil stockpile seed mix, this application \vill <br />be approved. <br />STATE C~ COLORADO <br />
